Terms of Service

These Terms of Service (“Terms”) govern your use of the PartyBrain mobile application and website (the “Service”) operated by PartyBrain (“we,” “us,” or “our”). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to create a PartyBrain account. Users under 18 should have parental consent. Guest players (no account required) may participate using the Family content filter only.

2. Accounts

You are responsible for maintaining the security of your account and for all activities that occur under your account. You must provide accurate information when creating an account and keep it up to date. You may not share your account credentials or allow others to access your account.

3. User Conduct

When using PartyBrain, you agree not to:

  • Submit content that is harassing, threatening, hateful, or discriminatory.
  • Submit illegal content or content that promotes illegal activities.
  • Attempt to exploit, hack, or interfere with the Service or other players' experience.
  • Impersonate other users or PartyBrain staff.
  • Use automated tools, bots, or scripts to interact with the Service.
  • Attempt to reverse-engineer or extract the AI prompts or game logic.
  • Circumvent content filters or safety mechanisms.

Violations may result in warnings, temporary suspension, or permanent account termination at our discretion.

4. AI-Generated Content

PartyBrain uses our AI to generate game content including prompts, answers, trivia questions, and word puzzles. This content is generated in real-time and may occasionally be imperfect, inaccurate, or unexpected.

AI-generated content is provided for entertainment purposes only. We do not guarantee the accuracy, appropriateness, or quality of AI-generated content. PartyBrain is not responsible for any decisions made based on AI-generated content.

5. Intellectual Property

The PartyBrain name, logo, game designs, game modes, scoring systems, and all associated visual and interactive elements are the intellectual property of PartyBrain. You may not copy, modify, or distribute these without our written permission.

Content you create during gameplay (answers, responses) remains yours, but you grant us a limited license to display it within the game context and to process it through our AI systems for gameplay purposes.

6. Subscriptions and Payments

PartyBrain offers free and premium tiers. Premium subscriptions (Monthly and Annual) auto-renew unless cancelled at least 24 hours before the end of the current billing period. The Party Pass is a one-time purchase valid for 24 hours.

All purchases are processed through Apple App Store or Google Play. Refund requests must be directed to the respective app store. We do not process payments directly.

Prices may change with reasonable notice. Existing subscribers will be notified before any price change takes effect.

7. Service Availability

We strive to keep PartyBrain available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control. We are not liable for any loss or inconvenience caused by downtime.

8. Limitation of Liability

PartyBrain is provided “as is” for entertainment purposes. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Account Termination

We may suspend or terminate your account at any time for violations of these Terms or our community guidelines. You may delete your account at any time through Settings → Account → Delete Account. Upon termination, your right to use the Service ceases immediately, and your data will be deleted according to our Privacy Policy.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of British Columbia, Canada.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice in the app or sending an email to registered users at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
